Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MyVault application and service ("Service") operated by MyVault ("us", "we", "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Account Registration and Security
1.1 Account Creation
To use MyVault, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
1.2 Account Security
You are responsible for safeguarding the password and encryption keys that you use to access the Service and for any activities or actions under your account. Due to our zero-knowledge architecture, we cannot recover your passphrase if you lose it. Your passphrase is the key to decrypting your data, and without it, your data will remain permanently encrypted and inaccessible.
1.3 Security Notifications
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
2. Privacy and Data Protection
2.1 Zero-Knowledge Architecture
Our Service operates on a zero-knowledge architecture, which means we cannot access, read, or share your encrypted data. Your data is encrypted using keys derived from your personal passphrase, which we do not store or have access to.
2.2 Data Processing
Any processing of your data (such as AI-powered organization) occurs within secure enclaves using temporary decryption that is only accessible through your authenticated session. We cannot and will not access your unencrypted data.
2.3 Data Collection
We collect limited information necessary to provide the Service, such as account credentials, device information, and usage metrics. Please refer to our Privacy Policy for complete details on the information we collect and how we use it.
2.4 Third-Party Services
MyVault may integrate with third-party services (such as Google Drive or iCloud) at your request. Any information shared with these third-party services is governed by their respective privacy policies. We recommend reviewing the privacy policies of any third-party services before connecting them to MyVault.
3. Content and User Data
3.1 Your Content
You retain all rights to your content stored within MyVault. By using our Service, you grant us the limited rights necessary to provide the Service to you, such as storing encrypted copies of your files and performing AI processing within our secure environment.
3.2 Prohibited Content
You may not use the Service to store or share:
- Content that violates applicable laws or regulations
- Content that infringes on intellectual property rights
- Malicious code or viruses
- Content that is harmful, threatening, abusive, or otherwise objectionable
- Content involving the exploitation of minors
3.3 Content Responsibility
You are solely responsible for all content you upload, store, or share through the Service. Due to our zero-knowledge architecture, we cannot monitor the content you store but reserve the right to terminate accounts that we have reason to believe violate these Terms.
4. Beta Program Terms (Applicable during Beta Period)
4.1 Beta Nature of Service
During the beta period, the Service is provided for testing and evaluation purposes. Features may be incomplete, contain errors, or change significantly before public release.
4.2 Feedback
We encourage beta participants to provide feedback. By providing feedback, you grant us a non-exclusive, irrevocable right to use that feedback without compensation or attribution.
4.3 Beta Period
The beta program has a limited duration as communicated in the beta program documentation. We reserve the right to terminate the beta program or your participation at any time.
4.4 No Warranty During Beta
During the beta period, the Service is provided "as is" without warranty of any kind. While we implement robust security measures, beta services may have unknown vulnerabilities.
5. Service Limitations and Modifications
5.1 Service Availability
We aim to provide the Service on an uninterrupted basis but cannot guarantee that the Service will always be available, uninterrupted, or error-free.
5.2 Service Changes
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
5.3 Storage Limits
We may impose storage limits on accounts. These limits will be communicated within the Service and may change over time.
6. Payments and Billing (Future Implementation)
6.1 Pricing
While the beta version of MyVault is provided free of charge, future versions may include paid features or subscription plans. Pricing will be clearly communicated before any charges are implemented.
6.2 Billing
If you provide payment information, you represent and warrant that the information is accurate and that you are authorized to use the payment method provided.
6.3 Subscription Terms
Details regarding subscription terms, cancellation, and refund policies will be provided before the implementation of any subscription model.
7. Intellectual Property
7.1 MyVault IP
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of MyVault and its licensors. The Service is protected by copyright, trademark, and other laws.
7.2 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial purposes.
7.3 Feedback
If you provide feedback, ideas, or suggestions regarding the Service ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, disclose, distribute, and otherwise exploit such Feedback without restriction or compensation.
8. Termination
8.1 Termination by You
You may terminate your account at any time by following the instructions within the Service or contacting us. Upon termination, your data will be deleted from our servers, subject to any legal retention requirements.
8.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms.
8.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Due to our encryption practices, terminated accounts cannot be restored, and data cannot be recovered after deletion.
9. Limitation of Liability
9.1 Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Limitation of Liability
In no event shall MyVault, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- The deletion of, corruption of, or failure to store any content maintained or transmitted by the Service
- Any conduct or content of any third party on the Service
9.3 Data Loss
While we implement robust security measures, we cannot guarantee against data loss. You are responsible for maintaining separate backups of important information.
10. Indemnification
You agree to defend, indemnify, and hold harmless MyVault and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of:
- Your use and access of the Service
- Your violation of these Terms
- Your violation of any third-party right, including without limitation any intellectual property right or privacy right
11. Governing Law
These Terms shall be governed by the laws of [Jurisdiction], without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Service shall be instituted in the courts of [Jurisdiction].
